1 –COMPANY AND WEB SITE

 1.1 COMPANY
www.mytodo.com (hereinafter the "Website") is published by the THENSEL SNC company with registered head office situated at b.go E. Valla , 9 - 43121 Parma (PR) - Italy, registered with the Parma Company and Trade register under n°242847, with the VAT n. 02491780348.
The General Terms and Conditions of sale (hereafter referred to as TACS) detailed below apply to all orders of products or services placed on the website (« the products ») by any person (« the customer »). Placing an order by a customer implies complete adherence, without reservation, to the TACS.
MYTODO reserves the right to adapt or modify the TACS at any time. The version of the TACS applicable to any transaction are the TACS's published at the date and time of the order. Consequently, placing an order by a customer implies complete adherence, without reservation, to these TACS.
The TACS below apply to all orders of products and services placed via the Site (the "Products") from THENSEL SNC, operating the MYTODO brand, by any person (the "customer "). The Customer declares that has read and accepted the TACS prior to the placing of its Order.

 

 1.2 WEB SITE
www.mytodo.com is an e-commerce merchant owned and managed by THENSEL SNC.
The Website is available to all users of the Internet network and is accessible 7 days a week, 24 hours a day, subject to any interruptions, planned or unplanned, by THENSEL SNC or its providers. Due to technical maintenance and/or security reasons or any cases or circumstances outside of its control. THENSEL SNC is not liable for any damage incurred by any circumstances resulting in the unavailability of the Website.
THENSEL SNC does not guarantee the availability or accessibility of the Website nor does it guarantee the Website against any anomalies, errors, bugs, breakdowns, interruptions of access to the Website and does not guarantee that the content on the Website or the services it provides will be delivered without interruptions, timely or error-free.

The Website is accessible worldwide. 

2 – TO PLACE AN ORDER

 2.1 REGISTERING

To be able to place an order the customer must first register themselves on the Website and create an account with their details.

After registering, MYTODO will validate the registration and send the customer an email confirming the registration.

When creating an account, please control that all the personal details given are correct. Please remember to always update any personal information. In the event of an error in the given destination address, THENSEL SNC will not be responsible if the goods are not delivered.

You must be over 18 years of age to sign up to the Website, by signing up to the Website you are automaticly declaring to THENSEL SNC to be over the age of 18 and to be able to act with legal capacity and comprehension within the law. THENSEL SNC has the right to remove and cancel an account (without giving motives) at any time and at their discretion.

The TACS apply to the product once the order, including the details of the articles, their price and any associated expenses have been validated by the customer.

 2.2 THE PRODUCTS

The products offered for sale are those offered at the time of consulting the Website while stock poduction supplies. The information on the Website is automatically updated in real time, nevertheless while updating, a number of errors could occur for varied reasons, THENSEL SNC cannot be held responsible for any errors which could occur during these updates.

THENSEL SNC does its upmost to guaranty that the quality of the photographs on the Website give a true representation of its products. Due to digital representation of images on the internet, it could occur that the presentation of the product does not conform to the photographic representation of the product, this is a fact that the customer must understand and hereby accept.

 2.3 ORDER CANCELLATION

The contract for the use and purchase of MYTODO is instantaneous.

CANCELLATION OR MODIFICATION OF THE ORDER CONFIRMED BY THE USER IS NOT ALLOWED.

THENSEL SNC operators can not modify the order parameters relating to:

• Incorrect number of copies;

• Sending the same order more than once;

IT IS RECOMMENDED THAT THE USER CONFIRMS THE SENDING OF THE ORDER ONLY AFTER AN ACCURATE VERIFICATION OF THE SETTINGS.

We strive to fulfill our customers expectations. In certain rare circumstances it could occur that THENSEL SNC is not able to complete a placed order after the email of acceptance of the order has been sent to the customer. THENSEL SNC cannot be held responsible for the withdrawal of any article from its Webpage at any time without giving any prior notice to its customers, or to refuse to fulfill an order even after the email of confirmation has been sent.

If after an order has been placed, it is discovered that the order is partially or wholly out of stock, the customer will be informed by email of the partial delivery or cancellation of the order. In the case of an order in which an article or articles of that order are out of production, the customer has the right to be refunded the price of the article or articles which were out of production.

 2.4 EXCLUSION OF THE RIGHT OF WITHDRAWAL

According to the art. 59 paragraph 1 letter. a) and c) of the Consumer Code, Legislative Decree 206/2005 subsequent amendments and additions, the right of withdrawal is excluded as the complete execution of the service is immediate and the goods are made and customized on the basis of the User's instructions.

3 – PRICES AND TERMS OF PAYMENTS

The prices are quoted in Euro's on the Website 

On the Website the prices are quoted in Euro’s. The prices on the website are indicated with VAT included for all Countries.

The prices on the Website do not include shipping and delivery. These costs will be calculated and shown on the Webpage before the final confirmation of the order. THENSEL SNC has the right to change the price of any and all of its articles at any time. The price of any article in stock will be that shown on the Website at the time of confirmation of the order.

Any Customs Tax and Duties and any other form of taxation (except the previously mentioned TVA, VAT, SALES TAX) are not included in the prices quoted on the Webpage. These taxes, when they apply, must be played by the customer directly to the transport agent.

Payment of the products can be made by Credit Card or PayPal, by simply following the instructions found on the Website's payment page.

The accepted Credit Cards are: Visa, American Express, MasterCard and Discover.

Payments are settled by the security system Stripe using the SSL protocol (Secure Socket Layer), so that the information transmitted is encrypted by software and that no third party can read it during transport on the network.

The products are payable on the day of the order. Customer gives the MYTODO authorization to debit their account to the amount of the products ordered. Once the order and the payment are validated by THENSEL SNC, the order will be shipped.

The Customer warrants to the MYTODO that it has the necessary authorizations to use the method of payment when placing the Order. If the bank or the credit card company refuses to authorize a payment, or the PayPal account is not debited. The order will not be validated and the product will not be sent. In this case, MYTODO will send an email to the customer informing of the refusal.

The customer's account will be charged for the orders billed after confirmation of the Order.

In the event of non-compliance by a customer with the obligations under the TACS, and particularly in case of fraud or any attempt to fraud, and any incident of payment of the price of the Order, THENSEL SNC reserves the right to refuse any order from the customer.

THENSEL SNC may suspend or cancel any execution and / or delivery of an Order, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum due by the Customer to THENSEL SNC, in case of a payment incident, or in case of fraud or attempted fraud relating to the use of the Website and the payment of an Order.

If the bank or the credit card company refuses to authorize the payment or if the PayPal account is not debited, then the Order will not be validated and the ordered article will not be dispatched. In this case MYTODO will inform the customer of the event.

The data recorded byTHENSEL SNC is kept and serves as proof of any financial orders or transactions.

The data recorded by the use of PayPal or Credit Card constitutes proof of a financial transaction.

 

4 – DELIVERY

Deliveries from Monday to Friday in Italy are by the Post Office's Cronopost.

STANDARD DELIVERY TO ITALY: Deliveries Cronopost is made approximately in 4 working days (from Monday to Friday, excluding Saturdays and holidays). It is possible to ship all over the national territory except Livigno - Trepalle, Champion of Italy, San Marino and Vatican City. 

The delivery to the recipient or to a qualified person, foresees the signature for acceptance.

In case of non-delivery of the shipment on the first attempt, the delivery person leaves a notice to inform the recipient that a second delivery attempt will be made on the next working day. In case of non-delivery even on the second attempt, the delivery person leaves a new notice with the Post office references (also called "UP") where the shipment will be in stock. The recipient will be able to pick up the shipment at the UP according to the terms indicated on the notice of storage. The shipment will remain in storage for 10 working days, including Saturdays.

All stages of the process are tracked electronically from the moment the shipment is withdrawn from the Customer

EUROPE: Deliveries Cronopost International takes 3-7 working days from the date of shipping (from Monday to Friday, excluding Saturdays and holidays). 

In case of non-delivery of the shipment, the service included one/two delivery attempts, depending on the destination countries. In case of non-delivery even, the delivery person leaves a notice with the Post office references (also called "UP") where the shipment will be in stock. The recipient will be able to pick up the shipment at the UP according to the terms indicated on the notice of storage. The shipment will remain in storage approximately 15 including Saturdays and holidays).

All stages of the process are tracked electronically from the moment the shipment is withdrawn from the Customer

INTERNATIONAL DELIVERY - OUTSIDE OF EUROPE: Deliveries Cronopost International takes 7-10 working days from the date of shipping (from Monday to Friday, excluding Saturdays and holidays). 

In case of non-delivery of the shipment, the service included one/two delivery attempts, depending on the destination countries. In case of non-delivery even, the delivery person leaves a notice with the Post office references (also called "UP") where the shipment will be in stock. The recipient will be able to pick up the shipment at the UP according to the terms indicated on the notice of storage. The shipment will remain in storage approximately 15 including Saturdays and holidays).

All stages of the process are tracked electronically from the moment the shipment is withdrawn from the Customer.

The Customer can check the status of shipments online through the "Cerca Spedizioni" service on the site www.poste.it.

 

The delivery times on the Website are given as an estimate and only correspond to the average time needed for prossessing and delivery.

When delivered, if the parcel is opened, damaged, faulty or in a bad condition the customer must refuse to accept the delivery and send it back. If the customer decides to accept the parcel then the customer must write on the delivery receipt that the acceptance is with reservations, stating the conditions and any problems with the parcel, them communicate the event to MYTODO and to the delivery company within 3 working days.

THENSEL SNC cannot be held responsible or liable for any direct or indirect damages resulting from delays or damages due to delivery.

 

 5 – RETURN AND GUARANTEES

 

 5.1 RETURN

Any customer could shall return the item within 14 days from the day of the Delivery. After 14 days, the sale is final.

The products must be returned intact, undamaged and bearing their bar-code labels and any other seals that are part of them; it is not possible to reimburse customer for goods that are returned incomplete, ruined or damaged.

In such case, the customer must contact MYTODO by email at mytodo.co@gmail.com, with the order number, name/last name, item. The return request will be confirmed by Thensel snc to the customer by email. The customer must follow the procedure mentioned into the confirmation of the email.

Refund to the customer is made subject to the receipt of the Products returned by Thensel snc and its excellent condition.

A refund will be made once Thensel snc has received the item and the state of the item has been examined. Within 20 working days of the reception of the item by Thensel snc, a refund will be made through the same payment means made to pay the order.

The return of the Products is at the Buyer's expense and is at his own risk.

The return of the Products is free if the place of Delivery is in Italy, Metropolitan France, Germany, Belgium, Luxemburg, Netherlands, Austria, Ireland, United Kingdom, Ireland, Poland, Greece, Swizerland, Spain, Portugal, Finland; the Buyer may only make one free exchange request per order.

If the customer does not adhere to the Terms of Service including the conditions of return and exchange, 

Thensel snc cannot proceed to refund any product in question. If the product is defective or different from the one ordered, Thensel snc will pay for the return of the product.

 5.2 GUARANTEES

All products offered by the Company are subject to the legal guarantee of conformity provided for by law.

If at the time of delivery a visible defect is encountered, the customer must immediately report this sending an email to mytodo.co@gmail.com.

 6 – THE RETENTION-OF-TITLE CLAUSE

All the goods remain the property of THENSEL SNC until the full payment of the price is completed. Full payment of the price means the actual collection of the payment and not the delivery of a document creating an obligation to pay.

The risk of loss or deterioration of the goods as well as the liability for the damage they may cause is transferred to the Buyer as soon as the goods are delivered.

 

 7 – INTERLLECTUAL PROPERTY RIGHTS

All elements of this Site www.mytodo.co and the Website itself are protected by copyright, trademarks, designs and / or other intellectual property rights. These elements are the exclusive property of the THENSEL SNC. All rights are reserved.

These elements belong to THENSEL SNC or they are used with the agreement of their owners.

Any use by the or reproduction of the company names, marks and distinct signs belonging to the Company is strictly prohibited except in the case of prior express agreement with THENSEL SNC.

It is strictly forbidden to reproduce (except for personal and non-commercial use), publish, edit, transmit, distribute, display, remove, delete, and add to this Website and the elements and software contained.

 

 8 – APPLICABLE LAW AND JURISDICTION

These General TACS and the relations between MYTODO and the Customer are governed by the law of the Italian Republic. For any controversy inherent, deriving or in any way connected to these General TACS or to the use of the Service, the Court of Parma will be competent, excluding any other, or, in the case of Consumer Customer, the competent Court will be determined pursuant to art. 66 bis of the Consumer Code.

In the event of a dispute between the Client and THENSEL SNC concerning the interpretation, performance or termination of the TACS, THENSEL SNC strongly encourages the Client to contact the THENSEL SNC in the first instance to attempt to resolve the disagreement amicably. THENSEL SNC hereby notifies Clients that there are alternative dispute settlement options such as mediation or arbitration.

 

 9 – PERSONAL DATA AND COOKIES

In accordance with the law n ° 2004-801 of 6 August 2004, Law on the protection of individuals with regard to the processing of personal data and amending the law n ° 78-17 of January 06, 1978 relative to computers, files and freedoms", you have a right of access, modification, rectification and deletion of the personal data which concern you. MYTODO will not disclose your details to any third party companies besides companies involved in the payment and fulfillment of your order. 
This information is never shared with third parties or resold. Finally, MYTODO does not store any bank details. Transactions are processed entirely by PayPal or the secure payment module of our partner STRIPE.

To improve our service, the Website may use cookies. This means Clients do not have to log in each time you visit. A cookie is a computer file stored on Client’s hard disk, allowing the Client to be recognized, without time limitation. Clients can of course delete these cookies by disabling their use in their browser.
